Standard Terms of Sale

Quick Overview

  • Warranty: Each device is warranted against defects in materials and workmanship through its printed expiration date.
  • Remedy: Sole remedy is replacement of defective units returned freight prepaid.
  • Liability cap: Total liability shall not exceed the purchase price of the units giving rise to the claim.
  • Returns: Submit warranty claims to support@intublade.com. Replacements shipped at no charge upon defect confirmation.

IntuBlade: Standard Terms of Sale and Limited Warranty

1. Product Description

The IntuBlade® Video Laryngoscope System is a single-use video laryngoscope that connects directly to mobile devices via USB-C. It is a Class I medical device, 510(k) exempt, registered with the FDA, and manufactured in compliance with applicable FDA regulations. The device is a prescription (Rx) product restricted to sale by or on the order of a physician.

2. Limited Warranty

IntuBlade Co. warrants each device against defects in materials and workmanship through the expiration date printed on the product packaging. The sole and exclusive remedy under this warranty is the replacement of any defective unit returned to IntuBlade freight prepaid.

This warranty does not cover damage caused by misuse, modification, improper storage, use beyond the labeled expiration date, or failure to follow the Instructions for Use.

This warranty is in lieu of all other warranties, express or implied, including but not limited to warranties of merchantability and fitness for a particular purpose.

3. Product Liability Insurance

IntuBlade Co. maintains commercial product liability insurance covering claims arising from defects in the device. A Certificate of Insurance is available upon request.

4. Limitation of Liability

IntuBlade Co. is not liable for any injury, loss, or damage arising from the clinical decisions, actions, or omissions of individual healthcare providers using the device. Liability for clinical use, patient assessment, and procedural decision-making rests solely with the treating provider and their employing agency.

In no event shall IntuBlade Co. be liable for indirect, incidental, special, or consequential damages. IntuBlade's total liability shall not exceed the purchase price of the units giving rise to the claim.

5. Returns and Replacements

Warranty claims must be submitted to support@intublade.com within the warranty period. IntuBlade will ship replacement units at no charge upon confirmation of the defect. Non-defective returns are subject to a restocking fee.

6. Governing Law

These terms are governed by the laws of the State of Florida.
